Dispute between Patent Holder and Exploitation Company Coming to Blows

The court held a patent holder liable for damages to the claimant’s exploitation company. The claimant asked Nederhof to compute its loss of money flows. A complex matter, in particular because although all parties regarded the exploitation of the care product in question as extremely promising, there was no reference company or reference product on the market. Only start-up losses had been made. Nederhof used generic market data, evaluated the parties’ substantiated estimates and relied on the historic successes realised by the current exploitation.

The claimant filed the findings reported by Nederhof in the proceedings for the determination of damages.
