Suspension and Buy-Out of Partner

Client: Remaining partners

Industry: Greenhouse horticulture – vegetables

Two general partnerships of three limited liability companies were engaged in the packaging and sale of tomatoes. The two major partners decided to suspend the third partner and ultimately terminate the partnership. The third partner contested their decision, as well as the exit payment offered. Nederhof counseled the remaining partners’ lawyer, providing substantiation for the compensation offered based on economic and legal facts. The conflict culminated in arbitration proceedings, in which Nederhof acted as a party-appointed expert. The arbitrators ruled in favor of the majority partners.
