The civil law notary who was the party-appointed advisor, and responsible for drawing up the divorce settlement, was held liable as he had allegedly failed to file a claim for reversal of the division. The notary called on his insurer, who in turn appointed Nederhof as binding advisor, with the entrepreneur\u2019s consent. Nederhof performed a valuation as at the date of the divorce settlement (which was in the past).
